In the state of Florida, the rules for expungement are set forth in Florida Statute 943.0585 – 943.059 and in Chapter 11C-7 of Florida’s Administrative Code. These rules specify that:

  • You must not have been adjudicated guilty of any of the acts you were accused of and are trying to have expunged.  The acts you are trying to have expunged must not have been related to a sex offense or to certain other types of prohibited offenses.
  • You must complete a Certificate of Eligibility (CoE) and the state attorney must approve your CoE.
  • The Florida Department of Law Enforcement must approve your CoE.
  • A judge must sign your CoE. Typically, this is facilitated through submitting the certificate to a clerk of the court. A hearing may be held before a judge signs off on the CoE, but this is not the case in every situation.

After you have your expungement approved, it is your responsibility to send the signed order of expungement from the judge to all law enforcement agencies and government departments that have a record of the criminal charges being expunged from your record.

Expungement is a very limited right and there are many people in the state of Florida who will not be eligible for expungement. This does not mean you have no options.
